Collaborative Divorce In New Jersey

Portrait Of Happy familyLike many people considering divorce here in New Jersey, you may have heard or read about “collaborative divorce.”  What is Collaborative Divorce?  Is Collaborative Divorce a better option than traditional court litigation?

In stark contrast to the lengthy, costly and adversarial litigation process, collaborative divorce efficiently facilitates complete and satisfying resolutions, saving both time and money for each spouse.  The real benefit to collaborative divorce over litigation is that it puts the spouses in control of the outcome rather than putting the fate of their children and financial future in the hands of third parties in the court system, including court-appointed experts and judges.

Collaborative divorce is similar to mediation but it is generally more effective.  With collaborative divorce, both you and your spouse each have your own attorney and we work in a team environment in which additional professionals are added as necessary.  The end result is that both you and your spouse get “the best bang for the buck” because you are paying for only those professionals that can help the most.  As a result, legal fees are generally lower in collaborative divorce than in divorce litigation.

For instance, when putting together a parenting plan or when it becomes necessary to manage emotions to communicate effectively, a child specialist and/or a divorce coach on the collaborative divorce team would likely be far more cost effective and productive in facilitating an overall agreement than two litigation attorneys “fighting it out.”

Take Control Of Your Divorce

Divorce Mediation

Mediation works best for couples that have agreed they are headed for divorce and would like to save time and money by cooperating to reach a mutually agreeable resolution.

In order for mediation to be effective, it is important that both of you are committed to cooperating with one another and sharing financial information to maximize the chances for success. You deserve to have a skilled and competent divorce mediator who can explain the process to both of you fully and ensure that you both understand the process. It is also extremely important that you both trust and feel comfortable with me.

When you work with me, I will meet with both of you in the number of sessions that it takes to reach a mutually agreeable resolution of all issues, whether it be child custody, parenting time, child support, payment of college expenses, alimony, or division of marital assets and debts. By using unique and highly effective tools and techniques for neutralizing conflict, we will design a complete resolution that meets both of your needs, interests, and goals.

The initial session will focus primarily on how the mediation process works, and the issues to be resolved. We will also determine the most efficient and cost effective way to achieve a mutually agreeable resolution.
